Terms of Service
1. Acceptance of Terms
By accessing or using LumenForge.io (the "Service"), operated by Studio PxG LLC ("we," "us," "our"), a registered Service-Disabled Veteran-Owned Small Business (SDVOSB) based in Honolulu, Hawaii, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
LumenForge is a browser-based, AI-powered 3D development environment and simulation platform. The Service provides:
- AI-Assisted Code Generation: Natural language prompts generate Three.js, WebGL, and procedural 3D code via large language model (LLM) inference.
- Browser-Native IDE: A full-featured code editor, terminal, and 3D preview environment accessible from any modern web browser.
- Compute Credits ("Sparks"): A virtual currency system used to meter AI inference usage. Sparks are consumed per generation request and can be earned daily (free tier) or purchased through our payment processor.
- Export Capabilities: Users may export generated code and assets for use in their own projects.
3. Account Registration & Authentication
Access to the Service requires authentication via a supported third-party identity provider (currently Google via Clerk). You are responsible for maintaining the security of your account credentials. You must be at least 13 years of age (or the minimum age in your jurisdiction) to use the Service.
4. Subscription Tiers & Payments
The Service offers multiple subscription tiers:
- Free: Limited daily AI generations (20/day), basic features, 1 active project.
- Founder ($19/month): Expanded AI generations (200/day), 1,000 Sparks/month, priority inference, unlimited projects.
- Professional ($29/month): High-volume AI generations (500/day), 2,500 Sparks/month, advanced model access, team collaboration features.
- Studio (Custom pricing): Enterprise-grade features including team seats, HIPAA-compatible deployment options, custom SLAs, and dedicated support.
Payments are processed by Paddle.com Market Limited, our Merchant of Record. Paddle handles all billing, invoicing, sales tax, and VAT compliance on our behalf. By purchasing a subscription, you agree to Paddle's Terms of Use and Privacy Policy.
Subscriptions renew automatically unless cancelled. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period.
5. Refund Policy
We offer a 14-day money-back guarantee on all paid subscriptions. If you are not satisfied with the Service, contact us at billing@studiopxg.com within 14 days of your initial purchase for a full refund. Refunds for subsequent billing periods are handled on a case-by-case basis. Paddle processes all refunds in accordance with applicable consumer protection laws.
6. Acceptable Use
You agree not to:
- Use the Service to generate content that is illegal, harmful, abusive, or violates third-party rights.
- Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
- Circumvent usage limits, rate limits, or authentication mechanisms.
- Use automated tools (bots, scrapers) to access the Service without written permission.
- Resell, redistribute, or sublicense access to the Service without authorization.
7. Intellectual Property
Your Content: You retain all rights to code, assets, and content you create using the Service. LumenForge does not claim ownership of your generated outputs.
Our Service: The Service itself, including its design, source code, branding, and documentation, is owned by Studio PxG LLC and protected by applicable intellectual property laws.
AI-Generated Content: Content generated by the AI models is provided "as is." You are responsible for reviewing and validating any AI-generated code before use in production systems.
8. Data Processing & Privacy
Your use of the Service is also governed by our Privacy Policy. We process personal data in accordance with applicable data protection regulations including GDPR and CCPA.
9. Service Availability & Disclaimers
The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability. Scheduled maintenance windows will be communicated via our status page when possible.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STUDIO PXG LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STUDIO PXG LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
11. Termination
We may suspend or terminate your access to the Service if you violate these Terms or engage in activities that harm the Service or other users. You may terminate your account at any time by contacting support@studiopxg.com.
12. Governing Law
These Terms are governed by the laws of the State of Hawaii, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Honolulu County, Hawaii.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the Service. Continued use after changes constitutes acceptance of the updated Terms.
